There is no legal definition of next of kin in English law.  Sometimes the deceased may have specified a particular individual when they entered hospital, or maybe they filled in a form prior to engaging in a dangerous activity.  However, there will be many occasions when a council or a legal-executive will be given the task of resolving a recently deceased person’s affairs in the absence of any individual who knew them personally.

The dictionary defines a deceased’s next of kin as being the person or group of people they are most closely related to.  And from this definition it naturally follows that more than one relative may have an equal claim to be this person.  For example, the brother and sister of the deceased would clearly be of equal entitlement, or it may be that an only child will have several cousins, all of whom have an equal claim to be the closest blood relative.
